Federal Government Requirements for New Employees

  • Are you confused by the various procedures required to confirm the legal status of your new employees?
  • Are you overwhelmed by the new hire paperwork that is required when hiring a new employee?
  • Do you know which newly-hired employees are required to complete the Federal I-9 form?
  • Do you know who in your company is completing and reviewing all the forms for your new hires?
  • Are they trained to fill out an I-9 form correctly – according to Federal guidelines?
  • Has your company ever self-audited your I-9 forms to ensure you have them completed and correct?

Are You I-9 Compliant?

If you are unsure about the answer to any of those questions above, you could be putting your company at risk! With new legislation on the federal level regarding immigration reform, I-9 compliance is a hot topic and it’s getting hotter!

Completing an I-9 correctly is not as simple as it looks. Did you know that the Feds have issued a 69-page manual filled with rules and regulations on how to properly fill out an I-9? Did you know that it is required for every employee working in the United States to complete an I-9 and that is must be completed within 72 hours of the first date of employment of the employee? And, there are strict Federal requirements for new hires to supply specific types of supporting documents that confirm their right to work in the United States.

Non-compliance will cost you!

In 2018, the Department of Justice (DOJ) adjusted the penalty for I-9 violations up to $2,236 PER VIOLATION. Inflated fines, coupled with increased occurrences of audits, provide the opportunity for companies to expose themselves to large fines for individual instances of I-9 noncompliance.

Is Your New Employee’s Legal Status Confirmed?

One of the simplest, and most efficient ways of confirming the legal status of your new hire is to utilize the Federal Government’s E-Verify System. E-Verify is a federal web-based system which checks employment eligibility records against those of the Social Security Administration (SSA) and Department of Home Land Security (DHS). This system is one of the best ways to ensure that the employees you hire are legally allowed to work in this country. While E-Verify can help ensure you’re trying to get it right, it does require that the user be registered and certified to work within the E-Verify system. This requires time and money to obtain certification.
