New Eligible Leave Activities for Employees Planning Adoptions and Foster Care Placements for 2025
Effective January 1, 2025
Paid Leave Oregon now offers Pre-Placement Leave for eligible employees who are planning to adopt or foster a child.
Pre-placement Leave identifies activities that are part of the adoption or fostering process that are required by law to be completed when a prospective adoptive parent or guardian has been identified. The process is implemented to ensure that the potential match of the child with the prospective adoptive family is appropriate. These activities are designed to identify the child’s specific needs and to evaluate if the prospective adoptive family has the ability to provide for those needs.
Eligible pre-placement activities include:
- Training sessions to help adults comply with Oregon adoption or fostering laws
- Counseling sessions
- Court appearances
- Legal consultations
- Physical examinations
- Home studies
- Related travel to another state or country
- Other tasks essential to completing an adoption or foster placement
Employee Requirements:
- Oregon employees who have been employed for at least 90 calendar days receive job protection while they take pre-placement leave.
- Employees taking pre-placement leave can only take it on an intermittent schedule. Leave may be taken between the start and end date of their leave, but they may also work some days or weeks during this time frame.
